Please read these Terms and Conditions ("Terms") carefully before using Nook (the "Service"), operated by Nook ("we", "us", or "our"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By creating an account, purchasing access, or otherwise using Nook, you confirm that you are at least 16 years old and that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated herein by reference.
2. Description of Service
Nook is a web application offering digital planners, trackers, and productivity tools. Access is provided on a subscription or promotional basis; current pricing and available plans are listed on our website. The Service is provided "as is" and we reserve the right to change, suspend, or discontinue any feature at any time without prior notice.
3. No Uptime Guarantee
We do not guarantee that the Service will be available at any particular time or for any particular duration. The Service may be temporarily unavailable due to maintenance, updates, infrastructure failures, or circumstances beyond our control. We are not liable for any loss or inconvenience resulting from downtime or unavailability.
4. No Data Guarantee
While we take reasonable steps to protect your data, we do not guarantee that your data will not be lost, corrupted, or deleted. We are not responsible for any loss of data resulting from technical failures, human error, cyber-attacks, or any other cause. You are solely responsible for maintaining records of any data you consider important. We strongly recommend that you retain your own records of critical information.
5. Limitation of Liability
To the maximum extent permitted by applicable law, Nook and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of goodwill, or business interruption, arising out of or in connection with your use of (or inability to use) the Service — even if we have been advised of the possibility of such damages.
Our total cumulative liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.
6. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted, error-free operation. We do not warrant that the Service will meet your requirements or that any errors will be corrected.
7. User Content
You retain ownership of any content you enter into the Service. By using the Service you grant us a limited, non-exclusive, royalty-free licence to store and process your content solely as necessary to provide the Service. You are solely responsible for the accuracy, legality, and appropriateness of your content.
8. Payments and Refunds
Subscription fees are non-refundable except where required by applicable law. We reserve the right to change our pricing at any time; any price changes will apply to renewals occurring after the change date. Payment processing is handled by third-party providers (e.g. Gumroad) and is subject to their terms and conditions.
